If you are late in filling out the bracket, shouldn't you lose out on the top pick, i.e. if there were 12 possible choices and you fail to fill out after first game you should only have 1-11 available to you?

Nope, you lose out on the opportunity to get all your picks -- but it only sacrifices your lowest.   Otherwise the penalty would be too steep.
