I’d reckon. If special prosecutors can see their cases decapitated like this, it’ll gum up the system. I guess I never saw the problem with JS’ appointment, it’s been a routine practice forever. I figured it was headed towards appeal regardless, though, given the state of play lately. I don’t know that the majority of SCOTUS would rule Trump’s way either, especially given the Nixon decision was unanimous…those tend to not be disturbed. 1 Quote

Garland can appeal to the 11th circuit who've already shown previously they are not fans of Cannon's rulings. That will likely end up in the SC. More likely they will re-file the case with another judge/venue, likely DC. Quote
